Terms and Conditions

These Terms and Conditions (the "Terms") govern your access to and use of Riko, including our websites, applications, APIs, and related services (collectively, the "Services"). The Services are provided by RikoMX ("Riko") (the "Company", "we", "us", or "our").

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Who the Services Are For

The Services are designed for businesses and authorized users to interact with AI-assisted workflows that help place and manage orders (including via voice calls), manage operational data, and access dashboards and related tools. You must be legally capable of entering into a binding agreement, and you represent that you have authority to act on behalf of the business entity you represent.

2. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for activities that occur under your account. Notify us immediately if you suspect unauthorized access.

4. Customer Content and Service Data

Depending on your usage, the Services may process business operational information, order details, call metadata, transcripts, and similar information ("Customer Content").

You retain ownership of Customer Content. You grant us a limited license to host, process, transmit, and display Customer Content solely to provide, maintain, and improve the Services, comply with law, and enforce these Terms.

5. AI Features and Limitations

The Services may use machine learning and AI models to assist with tasks such as call handling, order placement, summarization, and workflow automation. AI outputs may be incomplete or incorrect. You remain responsible for verifying outputs as appropriate for your business.

7. Service Availability and Status Page

We strive to keep the Services available but cannot guarantee uninterrupted operation. We may perform maintenance, updates, or emergency changes.

We maintain a public status page for service availability communications and incident updates. If you experience an outage or degraded performance, please consult the status page and contact support if needed.

Support is provided as described in your plan or agreement. For support requests, contact juberth@riko.mx.

9. Fees and Payments

If you subscribe to paid Services, you agree to pay applicable fees and taxes. Payment processing may be handled by third-party providers. If your plan includes usage-based billing (e.g., call minutes, AI usage), fees may vary based on consumption.

10. Third-Party Services

The Services may integrate with third-party services (for example, cloud providers, communications providers, code repositories, productivity tools, and AI/ML providers). Third-party services are subject to their own terms and privacy practices. We are not responsible for third-party services outside our control.

11. Security

We maintain administrative, technical, and organizational measures designed to protect the Services and Customer Content. These measures include access controls, encryption in transit where supported, logging and monitoring, and secure development practices. No system is 100% secure; you understand and accept this risk.

12. Suspension and Termination

We may suspend or terminate access to the Services if required by law, if you violate these Terms, or if your use poses a security risk. You may stop using the Services at any time. Upon termination, your access will end, and we may delete or de-identify Customer Content in accordance with our Privacy Policy and any applicable agreement.

13. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

15. Indemnification

You agree to indemnify and hold the Company harmless from claims arising out of your use of the Services, your Customer Content, or your violation of these Terms.

16. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice (for example via the website or email). Continued use of the Services after the effective date of updated Terms constitutes acceptance.

17. Governing Law

These Terms are governed by the laws of Mexico, without regard to conflict of laws principles.
